When it comes to where you can carry a handgun, it is fairly common knowledge that a person without a handgun license may carry in their home and/or motor vehicle. However, many people fail to realize that state law specifically allows you to carry a loaded handgun on your boat as well!
As for having a handgun on a boat, it is perfectly legal if you fall into one of the following two groups. First, non-licensed people who are legal to possess; not committing any crime other than a class C misdemeanor regulating boating; who are not members of a criminal street gang; and the handgun is not in plain view may carry. Secondly, LTC holders may carry their handguns either concealed without the need for a holster or openly in a belt or shoulder holster.
In a situation that requires you to act in self-defense to occur while you are on a boat, it’s always a good idea to be prepared and know the law. Texas law classifies boats as vehicles and boats with overnight accommodations as habitations. This is important because there is a powerful legal presumption that the use of force and deadly force is reasonable against a person who is forcefully and unlawfully attempting to board your vessel.
